1. Rental conditions

• The minimum car rental period is 3 days.
• The rental price excludes fuel costs. If the fuel tank is less full at the end of the rental period than at delivery, charges will apply. A charge of ANG 25 applies for a quarter tank; for a Small SUV or larger vehicle, the charge is ANG 50 for a quarter tank.
• The rental car is delivered near the airport or to the renter's accommodation. Delivery is included as far as Grote Berg; beyond this area, an additional surcharge of ANG 35 applies.

2. Required identification

• At the start of the vehicle rental, you must bring the following document in the main driver's name:
• A valid driving licence, held for at least 1 year.

3. Age and driving licence requirements

• The renter must have held a category B driving licence for at least one year.
• The renter must be at least 23 years old.

4. Prohibited use

You may not use the car, or allow it to be used:

• For any purpose contrary to the law.
• For driving instruction.
• To push or tow any vehicle or trailer.
• To transport persons and/or goods in violation of any legal provision of Curaçao.
• To participate in car races, rallies, other sporting drives or puzzle rallies.
• By a driver who lacks the physical and mental fitness required to drive the vehicle. Such fitness is in any event presumed to be lacking if the driver has used substances that may affect driving ability.
• By a driver who does not hold a valid driving licence.
• On unpaved roads, for example at Shete Boka, San Juan or the Hato plains.
• In the park around Christoffelberg.
• The driver may not consume alcoholic drinks and/or narcotics before or while using the car.
• Smoking in the car is prohibited.
• Leaving belongings in the car, whether visible or out of sight, is prohibited, for example bags, clothing or towels.

5. Liability

• The renter must take proper care of the car.
• The renter is liable for all costs, fines imposed, a contribution to administration costs, and any further financial or other consequences of violations of road traffic or other laws involving the car, together with a contribution to administration costs.
• The renter is responsible for the vehicle, and the rental continues until Vibrant Car rental BV has carried out the final inspection of the vehicle.
• If the vehicle is returned after 18:00 or is dirty when returned, the renter remains liable for any damage discovered after the car has been washed, up to a maximum of 48 hours after the rental car is returned.
• The renter must lock the car when it is not in use.
• The renter must return the car in a condition that allows inspection. Charges may apply if the interior and/or exterior is too dirty.
• The renter must ensure that the key and any alarm remote do not get wet. In the event of loss or water damage, the renter is responsible for the full costs.

6. Maintenance

• The renter is fully responsible for using fuel suitable for the car.
• Any maintenance costs are borne by Vibrant Car rental BV. Maintenance may only be carried out on the instructions of Vibrant Car rental BV.

7. Loss or damage

• In the event of loss and/or damage, a defect in the car, or seizure by judicial authorities or under civil proceedings, the renter must immediately inform Vibrant Car rental BV.
• If further use of the car risks worsening any damage or defect, or could reduce road safety, the renter may not use the car until repairs have been completed with the permission of Vibrant Car rental BV.
• If damage results from any of the matters listed in Article 4, the full amount of the damage will be recovered from the renter. This applies to both the interior, including upholstery, and the exterior of the car.
• Damage must be reported to Vibrant Car rental BV immediately upon discovery, and the renter must pay Vibrant Car rental BV for the damage at that time.
• In the event of non-payment, debt collection will be initiated and the collection costs will be charged to the renter. Any costs associated with being unable to rent out the affected car will also be charged to the renter.

8. Accidents

In connection with the insurance policy, among other reasons, the renter is required to:

• Immediately inform Vibrant Car rental BV of any damage or accident: +599 9 5655889.
• Immediately notify Curaçao Road Service (Forensys), +599 9 9233, and the police, +599 9 866 6800.
• Leave the vehicle exactly where it is when damage is discovered. Do NOT move it.
• Immediately complete the accident report form, collect all details of any persons and vehicles involved in the accident, and record the details of any witnesses.
• Refrain from admitting fault in any form.
• Remain with the vehicle at all times until Vibrant Car rental BV or Curaçao Road Service removes the car, where applicable.
• Provide Vibrant Car rental BV and the insurance company with the requested cooperation in defending against any third-party claims. If the obligations set out in this Article are not complied with, insurance coverage will lapse and the renter will owe full compensation for the damage, plus administration costs.

9. Insurance

• The car normally has third-party liability insurance (WA). This means that if the renter is at fault, damage to the rental car is at the renter's expense.
• All-risk insurance is available and, if desired, may be requested from the rental company before the rental period begins. Rates vary by vehicle type. Insurance applies only if the General Terms and Conditions are fully complied with. In all cases, a deductible of ANG 450 applies and cannot be waived by paying an additional fee.

10. Express termination clause

• Vibrant Car rental BV is entitled to terminate the rental agreement without notice of default or court intervention and to repossess the vehicle, stating the reason, without prejudice to its right to compensation for costs, damage and interest.

11. Duration of the rental agreement

• If the rental agreement is extended, all its terms remain in force. The same applies if cars are exchanged.
• If the rental period is shortened, Vibrant Car rental BV is not responsible for refunding rental payments.

12. Tyres

• Punctures or damage to tyres are in all cases immediately at the renter's expense and are not covered by insurance.
• If one or more tyres need to be replaced, the renter must have this done at Napa Auto Parts Curaçao: +599 9 461 3867.
• Vibrant Car rental BV must be informed of this damage.

1. Huurvoorwaarden

• De minimale huurperiode van een huurauto is 3 dagen.
• De prijs van de huurauto is exclusief brandstofkosten. Indien de tank bij einde van de huurperiode minder gevuld is dan bij afleveren, worden kosten in rekening gebracht. Er wordt ANG 25,- bij een kwart tank en bij Small SUV of groter ANG 50,- bij een kwart tank in rekening gebracht.
• De huurauto wordt geleverd nabij de luchthaven of het verblijf van de huurder (we leveren tot maximaal ten hoogte van Grote berg, verder dan dat wordt er een extra toeslag van ANG 35,- inrekening gebracht).

2. Verplichte legitimatie

• Bij aanvang van huur van een voertuig dient u de volgende documenten op naam van de hoofdbestuurder mee te nemen:
• Geldig rijbewijs (minimaal 1 jaar in bezit).

3. Leeftijd/duur rijbewijs

• De huurder dient minimaal één jaar in het bezit te zijn van het B rijbewijs;
• De huurder dient minimaal 23 jaar oud te zijn;

4. Niet toegestaan:

Het is niet toegestaan de auto te (laten) gebruiken:

• Voor met de wet in strijd doel;
• Voor het geven van onderricht;
• Voor het aanduwen of trekken van enig voertuig of aanhangwagen;
• Voor het vervoer van personen en/of goederen in strijd met enige wettelijke bepaling van Curacao;
• Voor het deelnemen aan autoraces, rally’s of andere sportritten q puzzelritten;
• Door een bestuurder die niet over de lichamelijke en geestelijke gesteldheid beschikt die voor het besturen van het voertuig vereist is. Het ontbreken van die gesteldheid wordt in ieder geval verondersteld indien de bestuurder middelen heeft gebruikt die de rijvaardigheid kunnen beïnvloeden;
• Door een bestuurder die niet beschikt over een geldig rijbewijs;
• Op onverharde wegen; bijvoorbeeld bij Shete Boka, San Juan, Hato vlaktes;
• Op het park rondom de Christoffelberg;
• De bestuurder mag geen alcoholische dranken en/of verdovende middelen nuttigen voor of tijdens gebruik van de auto;
• Het is verboden in de auto te roken;
• Het is verboden spullen in de auto (zichtbaar of onzichtbaar) achter te laten (bijv. tas/kleding/handdoek, enz)

5. Aansprakelijkheid

• Huurder dient zorgvuldig met de auto om te gaan.
• Huurder is aansprakelijk voor alle kosten, opgelegde boetes vermeerderd met een bijdrage in de administratiekosten en verdere (financiële) gevolgen van overtreding van de Wegenverkeers- en overige wetgeving met de auto, vermeerderd met een bijdrage in de administratiekosten.
• Huurder is verantwoordelijk voor het voertuig en de huur loopt door tot het moment waarop Vibrant Car rental BV de eindinspectie van het voertuig heeft uitgevoerd.
• Indien het voertuig na 18uur of vuil ingenomen wordt van huurder, is huurder nog aansprakelijk voor eventuele schade geconstateerd na wassen van de auto, maximaal 48uur na inname huurauto.
• Huurder dient de auto bij niet-gebruik daarvan af te sluiten.
• Huurder dient de auto controleerbaar in te leveren, is de auto te vuil van binnen- en/of buitenkant dan kunnen hiervoor kosten in rekening worden gebracht.
• Huurder dient ervoor te zorgen dat de sleutel en evt. alarmkastje niet nat worden. Bij verlies of waterschade zijn volledige kosten voor rekening van huurder.

6. Onderhoud

• Huurder is volledig verantwoordelijk voor het tanken van voor de auto geschikte brandstof.
• Kosten van eventueel onderhoud zijn voor rekening van Vibrant Car rental BV en worden alleen uitgevoerd in opdracht van Vibrant Car rental BV.

7. Verlies of schade

• In geval van verlies en/of schade c.q. optredend gebrek aan de auto en/of in beslagneming door justitiële autoriteiten c.q. civielrechtelijke inbeslagneming, is huurder verplicht Vibrant Car rental BV hiervan onmiddellijk op de hoogte te stellen.
• Indien enige schade of gebrek bij verder gebruik van de auto het risico met zich meebrengt dat de schade c.q. het gebrek verergert c.q. verder gebruik kan leiden tot vermindering van de veiligheid op de weg, is de huurder verboden de auto te gebruiken totdat herstel (na toestemming van Vibrant Car rental BV) heeft plaatsgevonden.
• In geval van schade met als oorzaak een onder artikel 4 genoemd punt, wordt het bedrag van de geleden schade volledig op de huurder verhaald. Dit geldt zowel voor binnen- (bekleding) als buitenkant van de auto.
• In geval van schade moet direct bij constatering van de schademelding hiervan gemaakt worden bij Vibrant Car rental BV en de schade wordt op dat moment door de huurder aan Vibrant Car rental BV betaald.
• In geval van wanbetaling wordt incasso ingeschakeld en worden kosten van incasso bij huurder in rekening gebracht. Eventuele kosten in verband met niet kunnen verhuren van betreffende auto worden ook bij de huurder in rekening gebracht.

8. Ongeval

Mede in verband met de verzekeringspolis is huurder verplicht:

• Vibrant Car rental BV onmiddelijk van iedere schade of ongeval op de hoogte te stellen (+599 9 5655889);
• Onmiddellijk Curacao Road Service(Forensys) (+599 9 9233) en politie (+599 9 866 6800) te waarschuwen;
• Het voertuig exact zo laten staan bij constatering van schade, dus NIET verplaatsen;
• Het schadeformulier terstond in te vullen alsmede alle gegevens te verzamelen van de eventueel bij het ongeval betrokken personen en voertuigen, alsmede de gegevens te noteren van eventuele getuigen;
• Zich te onthouden van erkenning van schuld, in welke vorm ook;
• Ten alle tijden bij het voertuig te blijven tot Vibrant Car rental BV of Curacao Road Service de auto afvoerd indien dat van toepassing is.
• Vibrant Car rental BV alsmede de verzekeringsmaatschappij de verzochte medewerking te verlenen tot verweer met betrekking tot eventuele aanspraken van derden.Indien de in dit artikel omschreven verplichtingen niet worden opgevolgd zal de verzekering vervallen en de huurder volledige schadevergoeding verschuldigd zijn, vermeerderd met administratiekosten

9. Verzekering

• De auto is in beginsel WA verzekerd, dit wil zeggen dat bij schuld door huurder de schade aan de huurauto op kosten van de huurder vallen.
• Allrisk is mogelijk en kan indien gewenst voorafgaand de huurperiode aangevraagd worden bij de verhuurder (Tarieven verschillen per type huurauto). De verzekering is alleen van toepassing bij volledige navolging van de Algemene Voorwaarden. Verder geldt er in alle gevallen nog een eigenrisico van ANG 450,- die niet afkoopbaar is.

10. Uitdrukkelijk ontbindend beding

• Vibrant Car rental BV is gerechtigd de huurovereenkomst zonder ingebrekestelling of rechterlijke tussenkomst te beëindigen en zich weer in het bezit van het voertuig te stellen, met vermelding van reden, onverminderd haar recht op vergoeding van kosten, schade en renten.

11. Duur huurovereenkomst

• In geval van verlenging van de huurovereenkomst blijven alle voorwaarden van de overeenkomst van kracht. Dit zelfde geldt bij eventuele wissel van auto’s.
• In geval van verkorting van de huurperiode is Vibrant Car rental BV niet verantwoordelijk voor restitutie van huurgelden.

12. Banden

• Lekke banden of schade aan banden komen in alle gevallen direct voor rekening van de huurder, dit valt niet onder de verzekering.
• Wanneer er één of meerdere banden vervangen dienen te worden dient de huurder dit te doen bij Napa Auto Parts Curacao (+599 9 461 3867).
• Vibrant Car rental BV dient van deze schades op de hoogte te worden gesteld.

1. Condiciones de alquiler

• El período mínimo de alquiler de un vehículo es de 3 días.
• El precio del alquiler no incluye el combustible. Si al finalizar el período de alquiler el depósito contiene menos combustible que en el momento de la entrega, se cobrarán los gastos correspondientes. Se cobrarán ANG 25 por un cuarto de depósito; para un SUV pequeño o un vehículo de mayor tamaño, se cobrarán ANG 50 por un cuarto de depósito.
• El vehículo se entrega cerca del aeropuerto o en el alojamiento del arrendatario. La entrega está incluida hasta la zona de Grote Berg; más allá de esta zona se aplica un suplemento de ANG 35.

2. Documentación obligatoria

• Al inicio del alquiler del vehículo, deberá presentar el siguiente documento a nombre del conductor principal:
• Un permiso de conducir válido, obtenido hace al menos 1 año.

3. Edad y antigüedad del permiso de conducir

• El arrendatario debe estar en posesión de un permiso de conducir de categoría B desde hace al menos un año.
• El arrendatario debe tener al menos 23 años.

4. Usos prohibidos

No está permitido utilizar el vehículo ni permitir que se utilice:

• Para fines contrarios a la ley.
• Para impartir clases de conducción.
• Para empujar o remolcar cualquier vehículo o remolque.
• Para transportar personas y/o mercancías incumpliendo cualquier disposición legal de Curaçao.
• Para participar en carreras de automóviles, rallies, otras pruebas deportivas de conducción o rallies de orientación con acertijos.
• Por un conductor que no tenga las condiciones físicas y mentales necesarias para conducir el vehículo. En todo caso, se presumirá que no reúne dichas condiciones si ha consumido sustancias que puedan afectar su capacidad para conducir.
• Por un conductor que no disponga de un permiso de conducir válido.
• En carreteras sin asfaltar, por ejemplo en Shete Boka, San Juan o las llanuras de Hato.
• En el parque que rodea Christoffelberg.
• El conductor no podrá consumir bebidas alcohólicas y/o estupefacientes antes de utilizar el vehículo ni durante su uso.
• Está prohibido fumar en el vehículo.
• Está prohibido dejar objetos en el vehículo, tanto visibles como fuera de la vista, por ejemplo bolsos, ropa o toallas.

5. Responsabilidad

• El arrendatario debe cuidar adecuadamente el vehículo.
• El arrendatario es responsable de todos los gastos, las multas impuestas, una contribución a los gastos administrativos y las demás consecuencias financieras o de otro tipo derivadas de infracciones de la legislación de tráfico u otras leyes cometidas con el vehículo, más una contribución a los gastos administrativos.
• El arrendatario es responsable del vehículo y el alquiler continúa hasta que Vibrant Car rental BV haya realizado la inspección final del vehículo.
• Si el vehículo se devuelve después de las 18:00 o se devuelve sucio, el arrendatario seguirá siendo responsable de los daños que se detecten después de lavar el vehículo, hasta un máximo de 48 horas después de su devolución.
• El arrendatario debe cerrar con llave el vehículo cuando no se utilice.
• El arrendatario debe devolver el vehículo en condiciones que permitan su inspección. Se podrán cobrar gastos si el interior y/o el exterior están demasiado sucios.
• El arrendatario debe evitar que la llave y, si corresponde, el mando de la alarma se mojen. En caso de pérdida o daños por agua, todos los gastos correrán a cargo del arrendatario.

6. Mantenimiento

• El arrendatario es plenamente responsable de repostar con el combustible adecuado para el vehículo.
• Los gastos de mantenimiento correrán a cargo de Vibrant Car rental BV. El mantenimiento solo podrá realizarse por encargo de Vibrant Car rental BV.

7. Pérdida o daños

• En caso de pérdida y/o daños, aparición de un defecto en el vehículo, incautación por las autoridades judiciales o embargo en un procedimiento civil, el arrendatario debe informar inmediatamente a Vibrant Car rental BV.
• Si seguir utilizando el vehículo puede agravar cualquier daño o defecto, o reducir la seguridad vial, el arrendatario no podrá utilizarlo hasta que se haya reparado con la autorización de Vibrant Car rental BV.
• Si los daños se deben a cualquiera de los supuestos enumerados en el artículo 4, el importe íntegro de los daños se reclamará al arrendatario. Esto se aplica tanto al interior, incluida la tapicería, como al exterior del vehículo.
• Los daños deben comunicarse a Vibrant Car rental BV inmediatamente al detectarlos, y el arrendatario debe pagar a Vibrant Car rental BV por dichos daños en ese momento.
• En caso de impago, se iniciará el cobro de la deuda y los gastos de cobro se cargarán al arrendatario. También se le cargarán los gastos derivados de no poder alquilar el vehículo afectado.

8. Accidentes

Entre otras razones, por las condiciones de la póliza de seguro, el arrendatario está obligado a:

• Informar inmediatamente a Vibrant Car rental BV de cualquier daño o accidente: +599 9 5655889.
• Avisar inmediatamente a Curaçao Road Service (Forensys), +599 9 9233, y a la policía, +599 9 866 6800.
• Dejar el vehículo exactamente donde se encuentre al detectar los daños. NO moverlo.
• Rellenar inmediatamente el parte de accidente, recopilar todos los datos de las personas y vehículos que puedan estar implicados en el accidente y anotar los datos de los posibles testigos.
• Abstenerse de admitir culpabilidad de cualquier forma.
• Permanecer junto al vehículo en todo momento hasta que Vibrant Car rental BV o Curaçao Road Service lo retire, cuando corresponda.
• Prestar a Vibrant Car rental BV y a la compañía de seguros la colaboración solicitada para defenderse frente a posibles reclamaciones de terceros. Si no se cumplen las obligaciones de este artículo, la cobertura del seguro quedará sin efecto y el arrendatario deberá pagar una indemnización íntegra por los daños, más los gastos administrativos.

9. Seguro

• El vehículo dispone normalmente de un seguro de responsabilidad civil frente a terceros (WA). Esto significa que, si el arrendatario es culpable, los daños al vehículo de alquiler correrán a su cargo.
• Se ofrece un seguro a todo riesgo que, si se desea, puede solicitarse a la empresa de alquiler antes del inicio del período de alquiler. Las tarifas varían según el tipo de vehículo. El seguro solo es aplicable si se cumplen íntegramente las Condiciones Generales. En todos los casos se aplica una franquicia de ANG 450 que no puede eliminarse mediante el pago de un importe adicional.

10. Cláusula resolutoria expresa

• Vibrant Car rental BV tiene derecho a resolver el contrato de alquiler sin requerimiento previo de incumplimiento ni intervención judicial y a recuperar la posesión del vehículo, indicando el motivo, sin perjuicio de su derecho a ser indemnizada por los gastos, daños e intereses.

11. Duración del contrato de alquiler

• Si se prorroga el contrato de alquiler, todas sus condiciones seguirán vigentes. Lo mismo se aplica si se cambia de vehículo.
• Si se acorta el período de alquiler, Vibrant Car rental BV no es responsable de reembolsar los importes pagados por el alquiler.

12. Neumáticos

• Los pinchazos o daños en los neumáticos correrán en todos los casos inmediatamente a cargo del arrendatario y no están cubiertos por el seguro.
• Si es necesario sustituir uno o varios neumáticos, el arrendatario deberá hacerlo en Napa Auto Parts Curaçao: +599 9 461 3867.
• Vibrant Car rental BV debe ser informada de estos daños.
